Eminem Settling One Ringtone Dispute — Five More To Go

Eminem's legal push to halt several companies from selling ringtones of his songs via the Internet isn't over yet, but according to The Detroit News, the rapper's publishing companies have agreed to settle a lawsuit that had been filed back in

October.

Em's companies, Eight Mile Style and Martin Affiliated, had filed a lawsuit in U.S. District Court in Detroit against Cellus USA, FanMobile, Nextones.com, myPhonefiles and MatrixM, and sought court orders prohibiting these companies from illegally selling the ringtones. In February, Eminem's attorneys sued a sixth company — Florida-based Phattones Media Productions — making the same claims.

The rapper's lawyers reached an undisclosed settlement last week with Cellus USA, which is based in Colorado; the Detroit News reports that U.S. District Court Judge Gerald E. Rosen still needs to approve the deal. Cellus lawyer Mary Margaret O'Donnell said her client has agreed to stop distributing the ringtones, but declined to say whether it had paid any money to settle the lawsuit, saying, "the provisions of the agreement are confidential."

Howard Hertz, one of Em's lawyers, characterized the settlement as "amicable" and revealed his intention to take on distributors who sell Eminem songs to karaoke bars without obtaining proper licenses; he said he'll be filing suits against those companies in the coming months.

One of the five companies named in the initial ringtones suit, Nextones.com, failed to respond after being served with legal notices. On May 16, Rosen entered a default judgment in Eminem's favor for $195,000. Hertz said he'll be making several attempts to collect on the judgment. Jill Wheaton, who represents myPhonefiles, said that company is close to reaching a final settlement as well.
