Widow Of Travis Barker's Assistant Chris Baker Sues Aviation Companies, Pilots' Estates

Otilia Villar Baker's suit alleges negligence and wrongful death in September plane crash.

The widow of Travis Barker's assistant, "Lil" Chris Baker, filed suit on Tuesday against several aviation companies, a tire company and the estates of the two pilots who were also killed in the fiery South Carolina plane crash in September that also resulted in serious injuries to Barker and DJ AM.

According to an Associated Press report, Otilia Villar Baker filed the suit on behalf of herself and son Sebastian in Los Angeles Superior Court, alleging negligence and wrongful death.

The legal action is aimed at the same companies that Barker filed suit against last month — Clay Lacy Aviation, Goodyear Tire and Rubber, Bombardier Inc., Global Exec Aviation and Inter Travel & Services — and it claims that the companies contributed to the September 19 crash, which also took the life of Barker's bodyguard, Charles "Che" Still. Barker and DJ AM (born Adam Goldstein) were badly burned in the crash but are expected to make a full recovery. The suit seeks damages for pain and anguish Baker suffered before his death, loss of earnings, companionship and repayment of funeral and other costs.

Barker's lawsuit faulted the two deceased pilots — Sarah Lemmon and co-pilot James Bland — but does not seek damages from their estates, while Otilia Baker's suit does. TMZ reported that the suit claims the pilots "negligently decided to abort and/or reject the takeoff," whereas proper procedure would have been to take off even if a tire had ruptured.

According to the suit, which seeks unspecified damages, Baker suffered "severe pre- and post-impact injury, damage to property, pain, suffering, and emotional distress, and ultimately died due to fatal injuries sustained from said crash including but not limited to the post-impact fire." It also adds that his "death was not immediate." While the pilots, Baker and Still died in the aftermath of the crash, AM and Barker managed to jump out of the plane before it was engulfed in flames.
